Terms of Service
These terms are an agreement between you and BlinkyAI Private Limited, a company incorporated in India (CIN U62011UP2026PTC251859) with its registered office at
B203, Pushp Court, Muir Road, Civil Lines, Prayagraj, Uttar Pradesh 211001, India ("BlinkyAI", "we", "us"). They cover the theblinkyai.com website, the early-access waitlist, and the BlinkyAI app at app.blinkyai.app on the web, iPhone and Android ("the service"). Our Privacy Policy explains how we handle your data and is part of this agreement. By creating an account or joining the waitlist you accept these terms.1. The waitlist and the website demo
Joining the waitlist does not create a contract to supply the service. It does not reserve you a place or fix a price or a date. We keep waitlist details for no longer than the 90 days described in the Privacy Policy, and we remove you as soon as you ask.
The demo on the home page is a simulation. It runs in your browser on fictional sample data and is not connected to any real account. It is not a statement about how BlinkyAI will perform on your own data.
2. Who can use BlinkyAI
You must be at least 18 and able to enter a binding contract. You confirm your age when you sign up. You can use BlinkyAI for yourself or for your work. If you use it for an organisation, you confirm that you may connect that organisation's accounts, and these terms bind the organisation too.
3. Your account
Give us a real email address and keep your password to yourself. You are responsible for what happens under your account. Tell us at [email protected] if you think someone else has used it. One account is for one person.
4. What BlinkyAI does, and what you decide
BlinkyAI reads the accounts you connect, suggests decisions, drafts replies and plans your day. You decide. A message goes out only when you approve it, and you are responsible for what you approve, as if you had written it yourself. Check drafts before you approve them. BlinkyAI uses AI, and AI can misread a message, get a fact wrong or suggest the wrong time. Text written by AI is labelled in the app.
BlinkyAI is not a professional adviser. Its planning around sleep and recovery is general guidance on organising your day, not medical advice. Nothing it drafts is legal, financial or medical advice.
5. Services you connect
When you connect Google, Microsoft, Zoho, Slack, Todoist, WhatsApp, another mailbox, Apple Health or Health Connect, you authorise BlinkyAI to act for you inside that service: to read, to draft and, when you approve, to send or change things. You must have the right to connect those accounts. Your use of those services stays under their own terms. We are not responsible for them, their availability, or changes they make that affect BlinkyAI. You can disconnect any of them at any time.
6. WhatsApp
BlinkyAI connects to WhatsApp as a linked device on your phone, like WhatsApp Web. It is not an official WhatsApp Business integration, and WhatsApp (Meta) has not approved it. WhatsApp could limit or suspend accounts that use linked-device tools, or change WhatsApp so the connection stops working. By linking, you accept that risk. Do not link a WhatsApp account you cannot afford to have restricted. We may switch WhatsApp support off at any time. You can unlink at any time, from your phone or from BlinkyAI.
7. AI features and your allowance
AI features work only when you turn AI on. They are included in every plan, within two daily allowances that depend on your plan: one for AI you ask for, and one for the AI work BlinkyAI does by itself, such as preparing drafts. Each is counted over a rolling 24 hours. At a limit, those AI features pause or fall back to simpler versions until the allowance frees up, and the rest of BlinkyAI keeps working. AI included in your plan needs a confirmed email address.
If you add your own AI provider key, requests go to that provider under your agreement with them, and any charges they make are yours.
8. Plans and payment
BlinkyAI has a Free plan and two other plans, Pro and Chief of Staff. Free lets you clear five Desk decisions a day. Pro and Chief of Staff remove that limit and have larger AI allowances.
BlinkyAI charges nothing today. Paid plans are not on sale. Everyone is on Free unless we move an account to another plan, and only we can change an account's plan. Before we ever charge you, we will show you the price, the billing period, how renewal and cancellation work and the refund terms, and we will ask you to agree to them. We may change what each plan includes.
9. Acceptable use
You agree not to:
- use BlinkyAI to break the law or anyone's rights, or to send spam, harassment or messages people have not agreed to receive;
- connect accounts you do not have the right to use, or try to reach other users' data or our systems;
- probe, overload or interfere with the service, or get around its limits, including the AI allowances and rate limits;
- copy, reverse engineer or resell the service, except to the extent that Indian law expressly permits it despite a term like this one;
- use BlinkyAI to build a competing product or to train AI models;
- scrape the website, or create accounts or join the waitlist by automated means.
We may suspend or close an account that does these things. Section 13 explains how.
10. Your content
Your mail, messages, calendars, tasks, health data and anything else you bring stay yours. You give BlinkyAI permission to store, process and transmit that content, including through the providers named in the Privacy Policy, only to run the service for you. That permission ends when you delete the content or your account, subject to the backup period in the Privacy Policy. We do not train AI models on your content.
11. Our property and your feedback
The service, its software, the BlinkyAI name and logo belong to BlinkyAI Private Limited or its licensors. We give you a personal, non-transferable right to use the service while these terms apply. Nothing else passes to you.
If you send ideas, suggestions or bug reports, we may use them to improve BlinkyAI without paying or crediting you. You do not have to send any.
12. Availability and changes to the service
We work to keep BlinkyAI running, but we do not promise it will always be available or free of errors. We may add, change or remove features. If we plan to shut the service down, we will give you at least 30 days' notice and a way to export your data.
13. Ending the agreement
You can stop at any time by deleting your account in Settings, or at app.blinkyai.app/delete-account. We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect other users or the service. Where it is safe and lawful, we will tell you why first and give you a chance to fix the problem or export your data. When an account closes, we delete its data as the Privacy Policy describes. Sections 4, 10, 11, 14, 15 and 16 continue after the agreement ends.
14. Disclaimers
Apart from what these terms promise, the service is provided "as is" and "as available". To the extent the law allows, we make no other promises, express or implied, including that the service will be fit for a particular purpose, uninterrupted or error-free, or that AI output will be accurate.
15. Limits on liability
To the extent the law allows, BlinkyAI is not liable for indirect or consequential loss, lost profits or revenue, or lost data, arising from the service. That includes loss caused by a message you approved. Our total liability to you for everything connected with the service is limited to the greater of (a) what you paid us in the 12 months before the claim and (b) ₹5,000.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited — including liability for fraud, or for death or personal injury caused by negligence.
16. Governing law and disputes
These terms are governed by the laws of India. The courts at Prayagraj, Uttar Pradesh have exclusive jurisdiction. If you are a consumer living elsewhere, you keep the protection of any mandatory consumer law of your own country, and you may bring a claim in your local courts where that law allows. Please contact us first. Most problems are solved faster that way.
17. Grievances

18. Changes to these terms
We may update these terms as BlinkyAI changes. We will update the version and date at the top. For a change that matters to you, we will tell you in the app or by email before it takes effect. If you do not agree, you can delete your account. Continuing to use BlinkyAI after a change takes effect means you accept the new terms.
19. General
These terms and the Privacy Policy are the whole agreement between you and us about the service. If a court finds part of them unenforceable, the rest stays in force. If we do not enforce a term straight away, we can still enforce it later. You may not transfer these terms to someone else. We may transfer them to a company that takes over the service, and we will tell you if that happens.
